Background information
In the summer of 2023, the new battery regulation was adopted and came into force shortly thereafter.
The new EU battery regulation is intended to replace the previous EU Battery Directive from 2006.
The old EU Battery Directive primarily dealt with producer responsibility regarding the collection of batteries that had been placed on the market. The Battery Directive is still applicable during a transitional period until 18/8-2025.
The collection of spent batteries is also a focus in the new EU battery regulation, but there is also an emphasis on a circular and sustainable value chain to ensure easier access to recycling and reuse of valuable materials. Additionally, there is increased focus on requirements for design, quality, traceability, and safety regarding the use of batteries, including heightened requirements for labeling.
In the old Battery Directive, Portable batteries and Industrial batteries were covered by the directive.
In the new EU battery regulation, this is expanded to also include batteries for electric vehicles (EV), batteries for smaller electric motor vehicles (LMT), starter batteries (SLI), and the expansion of Industrial batteries into two subcategories depending on power (over/under 2KWh).
In general, it can be said that there are some very specific requirements for the large batteries, which we will address at a later date.
Below, we have focused on Portable batteries, as these represent the vast majority of the market.
